Types of Barcelona hospitality licenses
10 things you should take into account if you are looking for a transfer from a local Bakery with/without Tasting
If you are ready to start your bakery business, we recommend you contact real estate agencies specialized in transfers such as Kamvy.
If you're thinking about acquiring a license transfer for a Bakery with or without Tasting Room, it is very important that you take into consideration the following recommendations:
- In the Barcelona City Council, Bakery businesses with or without Tasting Rooms fall within the category of Specialized Food Activities, which is different from the category of Restaurants and Bars.
- Regulatory Framework: Bakery businesses are regulated by the PECAP (Special Plan for Commercial Equipment for Food Businesses in Barcelona).
- Classification by the Municipal Council of Commercial Establishments: According to the Plenary Agreement of the Municipal Council of 24.07.2013, Bakeries with Tasting Rooms correspond to the category EC1.1 Personalized Food Sales and Small Commercial Establishments where the seller attends to the buyer individually (bakery zone). On the other hand, according to the PECAB, bakeries that require a production center will need to apply for a license with the authorization of a bakery.
- Smoke Extraction: If the Bakery zone has ovens with a power of no more than 75Kw, they do not require smoke extraction.
- Regarding its Location and Municipal Zoning: It is important to consider that the Municipal Council has established specific zones in the territory of Barcelona called ZE and their respective use plans, where certain specific treatment areas called ATE are contemplated. For more details, access the following link of the PECAP.
- Terraces: If the establishment has terraces, the surface area of these, for the purposes of calculation, is also considered a Tasting Room. This is specified in the Official State Gazette BOE-A-2017-11320.
- Artisan Bakeries, in addition to the requirements indicated in the previous point, may have Tasting Rooms, provided that the owner has a food artisan card or master artisan card, or if they market products produced by an artisan food company. In both cases, the owners must have accreditation issued by the Generalitat.
- Campaign for Economic Reactivation of the Restaurant Sector organized by the Barcelona City Council, in the following guide you can find all the commercial management tools developed by the Barcelona City Council in order to reactivate the tourism and restaurant sector.
- Opening Hours: You must take into account the authorized commercial hours, as the City Council updates and publishes them continuously at the following link: https://ajuntament.barcelona.cat/comerc/es/horarios-comerciales.
Maximum Tasting Room Areas:
According to the Special Plan for Commercial Equipment for Food Businesses in Barcelona (PECAB)-Edition of 2011, the calculation of the maximum sales or Tasting Room area will be carried out as follows:
a) Maximum sales area permitted in each specific case plus a percentage of:
- 75% of the first 250 sqm
- 50% of the surface area between 250 and 400 sqm
- 30% of the surface area over 400 sqm
b) The sales area for food products cannot exceed 2,500 sqm.
